1.0 OWNERSHIP OF PLATFORM PROPRIETARY ASSETS

The Encity web portal (https://encity.in/), mobile applications, system architectures, database designs, source code, object code, underlying algorithms, user interface layouts, visual designs, graphics, text elements, marketing copywriting, sounds, music, and the unique combination and arrangement thereof are the exclusive proprietary property of Minovox Ed Tech Pvt. Ltd. (“Company”).

All brand names, product names, logos, slogans, and service marks—specifically including the “Encity” and “Minovox” names and stylized marks—are protected trademarks owned directly by the Company or its corporate licensors. All rights are explicitly reserved under the Indian Copyright Act, 1957, the Trade Marks Act, 1999, and international intellectual property treaties.

2.0 LIMITED USER LICENSE GRANT

The Company grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable personal license to download, install, access, and browse the Platform strictly for its intended use: discovering hyper-local services, managing legitimate business listings, and executing authorized marketplace bookings.

2.1 Explicit Prohibitions

Under this license, you are strictly prohibited from:

  • Copying, reproducing, distributing, modifying, scraping, mining, or creating derivative works of any Platform content or code without formal written permission from our executive directors.
  • Decompiling, reverse-engineering, or disassembling the mobile application source files or API configurations.
  • Using automated scripts, bots, spiders, or crawlers to extract business listing phone numbers, text data, or pricing information from https://encity.in/.

3.0 USER-GENERATED CONTENT & LICENSE TO ENCITY

When you upload, submit, or publish content to the Platform—including business descriptions, service portfolios, logos, trade certifications, text reviews, and photographs of completed repairs (“User-Generated Content” or “UGC”):

  1. Ownership Retention: You retain full legal ownership of your original content, intellectual property, and registered corporate logos.
  2. License Grant to Company: You grant Minovox Ed Tech Pvt. Ltd. a worldwide, perpetual, irrevocable, royalty-free, non-exclusive, transferable, sub-licensable license to host, store, cache, reproduce, display, adapt, distribute, and modify your UGC. This license allows us to display your business details publicly across our directory, syndicate information to search engines, and run digital promotions for the Platform.
  3. Representation of Rights: You represent and warrant that you possess all necessary copyrights, trademarks, permissions, and licensing clearances to upload your content, and that your UGC does not violate the intellectual property rights of any third party.

4.0 POLICY AGAINST INFRINGEMENT (DMCA / INTERMEDIARY COMPLIANCE)

Encity operates as an intermediary under the Information Technology Act, 2000. We do not preview all business listings or user reviews before publication. However, we strictly respect third-party intellectual property rights and maintain a zero-tolerance policy for copyright or trademark infringement.

If you believe that any material, business profile image, or text listing hosted on the Platform infringes upon a valid copyright or registered trademark that you own or legally represent, you have the right to submit a formal Takedown Notice to our designated Legal & IP Compliance Desk.

5.0 INTELLECTUAL PROPERTY INFRINGEMENT TAKEDOWN PROCEDURE

To file a formal infringement notice with Encity, your written communication must be sent to support@encity.in and must include the following information:

  1. Signature: A physical or electronic signature of the intellectual property owner or a person authorized to act on behalf of the owner.
  2. Identification of Infringed Work: Clear identification of the copyrighted work or registered trademark claimed to have been infringed (including registration numbers and country, if applicable).
  3. Identification of Infringing Material: Description of the specific content or listing on Encity that you claim is infringing, with precise URLs or in-app location details to help us locate the material.
  4. Contact Information: Your full legal name, business address, telephone number, and official email address.
  5. Good Faith Statement: A formal statement stating that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright/trademark owner, its agent, or the law.
  6. Accuracy Statement: A statement that the information in your notification is fully accurate and, under penalty of perjury, that you are the rightful intellectual property owner or are legally authorized to act on their behalf.

6.0 ACTIONS AND COUNTER-NOTICES

Upon receiving a valid, compliant infringement notice, Encity will act swiftly to restrict access to or permanently remove the alleged infringing material from our web and mobile directories. We will also notify the affected user or Service Provider of the takedown.

If a Service Provider believes their listing was removed or disabled by mistake or misidentification, they may submit a formal Counter-Notice to support@encity.in. This counter-notice must contain clear proof of licensing, registration, or authorization to use the disputed assets. Encity reserves the right to reinstate or keep the content disabled pending legal resolution or mutual agreement between the disputing parties.
